TORREY, N.Y. — A New York State Supreme Court judge has ruled in favor of Greenridge Generation, overturning the state Department of Environmental Conservation’s denial of the company’s Title V Air permit renewal.

Justice Vincent DiNolfo deemed the DEC’s actions “arbitrary and capricious,” criticizing its interpretation of the Climate Leadership and Community Protection Act. The ruling permits Greenridge, a subsidiary of Atlas Holdings, to maintain operations, preserving local employment.

Greenridge praised the decision as a stand against “politically motivated governmental overreach.”
